You can reach us at this address for all questions about data protection. We have not appointed a data protection officer because we are not legally required to do so.
Our website is hosted by Webflow, Inc. (San Francisco, USA). Whenever a page is accessed, Webflow processes technically necessary data: your IP address, the date and time of access, the page accessed, the page visited previously, and your browser and operating system. This data is needed to deliver the website and to protect it against attacks. The legal basis is our legitimate interest in a secure and functioning website (Art. 6(1)(f) GDPR (DSGVO)).
We have concluded a data processing agreement with Webflow. In this context, data may be transferred to the USA. Webflow is certified under the EU-US Data Privacy Framework; in addition, the standard contractual clauses of the European Commission apply.
Our website and booking portal do not set any cookies for statistical or advertising purposes. We do not use advertising pixels or embedded content from social networks. For simple visitor statistics we use Plausible Analytics (see below). Plausible works without cookies. That is why there is no consent banner on the website.
In the booking portal we use two technically necessary cookies: one for logging in to your rider account and one to protect the forms against misuse. Both contain only a random identifier, can only be read over an encrypted connection and become invalid at the end of the session or when you log out. The legal basis is Section 165(3) of the Telecommunications Act 2021 (TKG 2021) and our legitimate interest in a secure booking process (Art. 6(1)(f) GDPR (DSGVO)).
Visitor statistics with Plausible Analytics
To see which pages and dates are in demand, we use Plausible Analytics provided by Plausible Insights OÜ, Västriku tn 2, 50403 Tartu, Estonia. Plausible does not set cookies and does not store anything on your device. It records the page visited, the website you came from, country, device type, browser and operating system, as well as individual clicks, for example on “Book now”, the language selection or the schedule download. Your IP address is used only briefly, together with a random value that changes daily, to form an identifier, and is not stored. We cannot identify you from this data. We do not send names, e-mail addresses or booking numbers to Plausible. The data is processed in the EU. The legal basis is our legitimate interest in designing our offer according to our visitors’ needs (Art. 6(1)(f) GDPR (DSGVO)).
The fonts used are delivered locally via our hosting provider. No connection to third-party servers (for example Google Fonts) is established for this purpose.
So that prices and available places on the website are always up to date, the website loads this information from our booking portal. In doing so, our own server processes your IP address and the technical access data as described under point 2. The legal basis is Art. 6(1)(f) GDPR (DSGVO).
If you write to us via the contact form, we process your first name, surname, e-mail address, optionally your telephone number, the subject of your enquiry and your message. The information is stored at Webflow and forwarded to our mailbox. If you write to us directly by e-mail, we likewise process the data from your message. Our e-mail mailbox is operated by Microsoft (Microsoft Ireland Operations Limited, Dublin, Ireland).
We use this data only to answer your enquiry. The legal basis is the initiation or performance of a contract (Art. 6(1)(b) GDPR (DSGVO)), otherwise our legitimate interest in answering your enquiry (Art. 6(1)(f) GDPR (DSGVO)). We delete the data as soon as your enquiry has been dealt with and no statutory retention obligations apply.
For a booking, we process the following in our booking portal:
We need this data in order to carry out your booking, to assign you to a suitable group, to be able to act quickly in an emergency and to issue you with an invoice. The legal basis is the performance of the contract (Art. 6(1)(b) GDPR (DSGVO)) and, for the invoices, our statutory retention obligation (Art. 6(1)(c) GDPR (DSGVO)). Please inform your emergency contact person that you are passing on their name and telephone number to us.
For your rider account we store your e-mail address and your password. The password is stored only in encrypted form (as a check value); we cannot read it. This means you do not have to enter your details again the next time you book.
We send booking confirmations, invoices and links for setting your password automatically by e-mail. We retain booking and invoice data for seven years, as required by Austrian tax law (Section 132 of the Federal Fiscal Code (BAO)). Your rider account remains in place until you ask us to delete it.
The booking portal runs on a dedicated server at Hetzner Online GmbH (Industriestraße 25, 91710 Gunzenhausen, Germany) in the Nuremberg data centre. We have concluded a data processing agreement with Hetzner. The connection is encrypted throughout, and backups are stored in encrypted form.
If you put your name on the waiting list, we store your e-mail address and your interest (for example a season pass or particular dates) in order to inform you as soon as the pre-sale starts. The legal basis is your consent (Art. 6(1)(a) GDPR (DSGVO)). You can withdraw your consent at any time by e-mail to office@froeschlracing.com; the withdrawal applies for the future. We will then delete your details.
You pay by bank transfer. The payment data arising in this connection is processed by your bank and our bank under their own responsibility. We match the receipt of payment with your booking (Art. 6(1)(b) and (c) GDPR (DSGVO)).
Photos and videos are taken at our trackdays and races, including by photographers and videographers commissioned by us. We publish images in which participants can be identified on our website, in our social media channels (e.g. Instagram, Facebook), in press releases and in printed advertising material only with your consent, which you give in the participant declaration in the rider portal (Art. 6(1)(a) GDPR (DSGVO)). Consent is voluntary; your participation does not depend on it. You can withdraw it at any time with effect for the future, in your rider account or by e-mail to office@froeschlracing.com. We cannot recall advertising material that has already been printed.
We use overview shots in which people can only be seen as part of what is happening at the event (e.g. paddock, start, spectators) on the basis of our legitimate interest in reporting on our events (Art. 6(1)(f) GDPR (DSGVO)). If you do not wish to appear in them, tell us on site or write to us; we will remove the images concerned.
Before the first event of a season, you sign our participant declaration in the rider portal. When you do so, we store your signature, the time of signing, the applicable version of the text and your details (name, contact details, motorcycle, emergency contact) as a PDF. This serves to handle your participation and to provide evidence of the agreed conditions of participation (Art. 6(1)(b) and (f) GDPR (DSGVO)). We retain the declaration for three years after the end of its period of validity and then delete it.
On our website we link to Instagram, Facebook and Google Maps. These are simple links. Only when you click on a link are you forwarded to the respective provider, whose data protection provisions then apply.
We only pass on your data where this is necessary for the purposes stated: to our IT service provider, who looks after the website and booking portal for us, to Webflow, Hetzner, Microsoft and Plausible Insights as processors, to our tax advisers, and to banks and authorities where we are legally obliged to do so. We do not sell any data.
You have the right of access, rectification, erasure and restriction of processing, the right to data portability and the right to object to processing based on our legitimate interest. You can withdraw any consent you have given at any time with effect for the future. To do so, write to us at office@froeschlracing.com.
If you believe that we are not processing your data lawfully, you can lodge a complaint with the Austrian Data Protection Authority (Österreichische Datenschutzbehörde): Barichgasse 40–42, 1030 Wien, dsb@dsb.gv.at, www.dsb.gv.at.
We adapt this privacy policy when our website, our booking portal or the legal situation changes. The version published here at the relevant time applies.
