Terms and Conditions (T&Cs)

Scope of application

These terms and conditions apply to contracts for the organisation and implementation of motorcycle events, motorbike safety training, cornering training, sports riding training, race training and racing events, as well as all related services and goods provided by FröschlEvent GmbH and its contractual partners.
The terms and conditions shall only apply with the prior written consent of the parties involved or other documentation of a business relationship that has been entered into.

The House Rules (see below) of Karl Fröschl Event GmbH, which form an integral part of these General Terms and Conditions, also apply.

Contract content, Contractual agreement

After registering for the respective event, the participant will receive written confirmation of registration. This confirmation constitutes the conclusion of the contract between FröschlEvent GmbH and the customer.
The participant will receive final confirmation of payment/registration after the registration fee has been received.
The contractual services (type, scope) are bindingly specified in the service description of the offer for the booked event.

Payment terms, Payment methods

After submitting a binding registration/booking, the participant undertakes to pay the participation fee and any additional services booked to FröschlEvent within 14 days.
FröschlEvent reserves the right to withdraw from the contract and cancel the booked event in the event of late payment.
FröschlEvent hat das Recht, den Teilnahmebeitrag für eine Veranstaltung jederzeit zu ändern; es gilt grundsätzlich der Preis, der zum Zeitpunkt der Buchung im Internet angegeben ist. Eine nachträgliche Änderung des Preises für bereits bestehende Buchungen ist natürlich ausgeschlossen.
Dem Kunden werden über einen Zahlungsdienstleister (PayPal o.Ä.) verschiedene, für den Kunden grundsätzlich kostenlose Zahlungsarten, angeboten. Es gelten die Allgemeinen Geschäftsbedingungen des jeweiligen Zahlungsdienstleisters, die dem Kunden vor Abschluss des Zahlungsprozesses zugänglich gemacht werden.

Cancellation policy

Cancellation is possible without giving reasons within 7 days of receipt of the booking, provided that there are at least 28 days between the date of cancellation and the start of the booked event.
Cancellations must be submitted in written form via email to office@froeschlracing.com

Nomination of a substitute rider

Ein Ersatzfahrer kann bis 48 Stunden vor Veranstaltungsbeginn genannt werden.
 Die Nennung eines Ersatzfahrers kann ausschlißlich per Mail vorgenommen werden. 
Eventuelle Versicherungsleistungen können nicht auf den Ersatzfahrer übertragen werden.
 Bearbeitungsgebühr für die Umbuchung: 25€

Legal disclaimer

By signing this document, the participant confirms that they have been informed of the risks associated with motor sports and are fully aware of them. The participant is therefore aware of the risks and dangers associated with participating in motor sports events in terms of their property and physical health.
Participants are also informed that riding on the race tracks is only permitted with a motorcycle that is technically sound for use on a race track, with suitable and fully functional motorcycle protective clothing and in a physical condition appropriate for this high-risk sport, in order to minimise the dangers and risks associated with motorcycle racing. Anyone who is under the influence of alcohol or drugs is not permitted to ride or operate a vehicle on any part of the track. A person is considered to be under the influence of alcohol if their blood alcohol content exceeds 0.0 g/l (0.0 per mille) or their breath alcohol content exceeds 0.0 mg/l.
If an event is cancelled due to external circumstances (such as force majeure), Karl Fröschl Event GmbH shall nevertheless be entitled to the full agreed fee. Participation in the riders' briefing is mandatory for all participants.
Liability:
It is agreed that—save for personal injury—the liability of Karl Fröschl Event GmbH for all claims, on whatever legal basis, is limited to intentional and grossly negligent conduct. Accordingly, Karl Fröschl Event GmbH’s liability for indirect and consequential loss (in particular consequential loss resulting from defects)—such as loss of profit, business interruption, costs arising from production stoppages, loss of anticipated savings, loss of interest, and loss arising from third-party claims against the participant—is likewise limited to such intentional and grossly negligent conduct.
The athlete participates in the respective event at their own risk with regard to risks typical for the sport. The athlete is also aware that damage may occur due to unforeseeable or atypical dangers, in particular due to misconduct on the part of participants. The participant is liable to all parties involved (e.g. organisers, track personnel, other participants) for their behaviour and for the proper technical condition of their motorcycle, and further confirms that they are fully aware of and will comply with the rules of conduct on the entire race track premises (including the paddock). 
The participant agrees that images and film recordings made during the event may be published on the organiser(s)' website(s), in press releases and in printed materials.

Technical regulations

All roadworthy motorcycles are permitted at FröschlRacing events!
Motorrad:

  • Your motorbike must be in perfect working condition.
  • Fully functional brake system.
  • If possible, secure drain plugs with wire.
  • Replace antifreeze with water (not mandatory, but definitely recommended).
  • Only ride with tyres that are in good condition and have sufficient tread!
  • Remove indicators, headlights, mirrors and rear lights if possible, otherwise tape them carefully.
  • Remove number plate and holder.
  • Sharp edges (e.g. sawn-off frame tubes) are not permitted.

Exclusion due to exceeding the specified dB values does not entitle the participant to a refund of the participation fee. If the race track has a dB limit, this will be indicated on the product page. Events may be interrupted or longer breaks may be taken to regulate the noise level if numerous participants violate the noise regulations at the same time.
The organiser reserves the right to exclude vehicles that do not meet technical safety requirements from the event. Regular checks will be carried out for this purpose.

Protective gear

Only riders wearing proper and complete protective gear will be permitted to participate!
Good motorcycle gear is key to your safety. Before heading out on the track, make sure your helmet buckle and all zips are closed.

Helmet: undamaged full-face helmet, intact fastener (preferably double D fastener). Flip-up helmets are NOT permitted.
Leather suit: one-piece or two-piece. The jacket and trousers must be connected with a zip! Keys, mobile phones, etc. must be removed from the suit (risk of injury in the event of a crash).
Textile clothing: Not permitted!
Back protector: All participants are required to wear additional back protectors if none are incorporated into the suit.
Boots: Ankles and shins must be covered.
Gloves: Precise fit – not sanded down or torn open

Start numbers

Each participant must mark their motorcycle with a starting number. The starting number will be communicated at the latest at the start of the event, but usually with the confirmation of entry. Any deviating, old starting numbers must be removed or covered up!
 The starting numbers must be affixed to the front of the vehicle in a clearly visible and legible manner.

The height of the start numbers must be at least 12-15 cm. Ideally, only black numbers on a white background!

Safety requirements

Throughout the entire duration of the training, participants must follow the instructions of the Fröschl Racing team and the track operators. Stopping on the track – for any reason whatsoever – is strictly prohibited. Entering the safety areas, especially the crash zones, is strictly prohibited for all unauthorised persons.
Endangering others through reckless riding/behaviour in the paddock and on the race track or disregarding flag signals will result in disqualification or exclusion from the event without compensation.

 

Pit lane:

  • Absolute smoking ban!
  • One-way street!
  • Must be ridden slowly.
  • Must be pushed against the direction of traffic.
  • Children are strictly prohibited from entering the pit lane.

Paddock:

  • All vehicles must drive at walking pace!
  • Failure to comply may result in disqualification or a warning.
  • Pets are usually completely prohibited from the entire race track facility (paddock, track, pit lane, etc.).
  • The house rules of the respective race track also apply here.

‘Force majeure’

If the event cannot take place for reasons beyond the control of Fröschl Event (e.g. cancellation by the race track operator, pandemic, extreme weather conditions, etc.), the participation fee will be refunded in full. In this special case, FröschlEvent will refund the entry fee to the participant as soon as the organiser has received a refund of the rental price from the race track operator (this is guaranteed by most of our race tracks!).
Alternatively, the entry fee will be credited to you. However, there is no entitlement to compensation. Further claims are expressly excluded. The event is considered to have taken place when the paper acceptance opens on site. If ‘force majeure’ occurs during the event, the participant is not entitled to a refund of the entry fee. If the riding time is shortened or cancelled completely due to, for example, oil on the track, a participant falling, damage to the track, bad weather, etc., the participant is not entitled to a full or partial refund of the entry fee.

Insurance

Participants are responsible for ensuring that they have adequate insurance cover.
All participants are strongly advised to take out accident insurance offered by FröschlEvent. The general and special terms and conditions of accident insurance apply.
Information about this must be received by the organiser when registering/booking for the event.
By signing, the participant confirms that they have valid international health insurance, provided that the event does not take place in their home country. If the participant does not have international health insurance, they must bear any medical costs incurred themselves.

General conditions and regulations during the event

All participants must report to registration/paper collection before starting training! Depending on the race track, additional online registration on the race track website may be required.
We will send the necessary links to all participants by email shortly before the event.
All participants must attend the drivers' briefing without exception. Attendance is mandatory! The drivers' briefing will take place at the beginning of the event and is also announced in the schedule.
Riders of different speeds may encounter each other during training and, if applicable, during the races. Therefore, special caution and mutual consideration are required. If a participant endangers the life and health of other participants through risky, reckless riding, they will be excluded from training. If a participant deliberately causes permanent damage to the race track (burnouts, etc.) or to the race track facilities, they will be held liable for the damage caused. This also applies to the insertion of nails, dowels, screws, etc. into paved surfaces in the paddock and in pit floors and pit walls.
Furthermore, the house rules of the respective race track must be observed. These are usually displayed in the pits and in the organiser's pit box.
The use of drones – for any purpose whatsoever – is strictly prohibited!

Photography and publication

Fröschl Event reserves the right to use photographs, videos, film recordings, etc. produced during the events for its own promotional purposes. Any recordings of participants and their accompanying persons may be published without additional approval. At the events we organise, only photographers and video producers authorised by us have the right to take photographs/film and use these recordings commercially.

House rules

  1. Scope of application
    FröschlEvent exercises its domiciliary rights throughout the entire event site, including the race track, paddock, spectator areas, car parks and all associated facilities. All visitors, participants, accompanying persons and other third parties are subject to the following provisions.

  2. Reasons for exclusion
    FröschlEvent is entitled to exclude persons from participating in or entering the event grounds, either in whole or in part, if they exhibit one or more of the following behaviours:
    a) Violation of the safety, order or conduct rules of the event, in particular on the race track or in the paddock;
    b) Excessive or unauthorised consumption of alcohol, drugs or other intoxicating substances that endangers one's own safety or the safety of third parties;
    c) Disruption of the event, in particular through noise, aggressive behaviour, harassment, dangerous driving manoeuvres or other actions that endanger participants, spectators or staff;
    d) Unauthorised sale, offering or advertising of goods, services or sponsorship activities without the express permission of FröschlEvent;
    e) Any action that significantly impairs the proper running of the event or endangers the well-being of others.

  3. Procedure and legal consequences

  • Exclusion may take place immediately and without prior warning if the situation so requires.

  • Affected persons are not entitled to a refund, reimbursement or reduction of the participation fee.

  • FröschlEvent is entitled to call in security personnel, stewards or the police if necessary to enforce the exclusion.

  1. Liability
    FröschlEvent shall not be liable for any damage or loss caused by the behaviour of excluded persons or their expulsion, unless this is due to intentional or grossly negligent action on the part of FröschlEvent. vorsätzlicher oder grob fahrlässiger Handlung von FröschlEvent.

  2. Applicability of the rules
    By entering the event grounds, visitors, participants and accompanying persons accept these house rules as binding. Violations entitle FröschlEvent to exclude persons from the event in accordance with these provisions.

Health/Pregnancy

Participants are required to be in good health when taking part in FröschlEvent activities. Anyone suffering from physical and/or mental health conditions that impair their ability to drive a vehicle may not take part in an event. Medication that impairs driving ability, as well as alcohol and drugs, are strictly prohibited during training!
In the event of violations, the person concerned will be immediately excluded from our training without entitlement.
FröschlEvent reserves the right to conduct alcohol or drug tests without prior warning.

Implementation and amendment of agreements

FröschlEvent is entitled to change, postpone or cancel an event and to change or replace it with an equivalent alternative to be determined by FröschlEvent if FröschlEvent deems this necessary for the proper execution and/or safety of persons, without FröschlEvent being liable for damages to the customer.

Data protection & publication

  • The general data protection conditions from the website apply www.froeschlracing.com
  • Names, start numbers, motorcycles, race results, photos and videos may be published on the homepage, in the annual overall rankings and on social media (e.g. Facebook, Instagram).

  • If you object to publication, please send an email to Karl Fröschl Event GmbH. Otherwise, your consent is deemed to have been given.

  • Subject to printing errors and changes.

House Rules

  1. Scope of application
    These house rules apply to all events organised by Karl Fröschl Event GmbH at all race tracks, as a supplement to the house rules of the respective ring operator. By entering the premises, visitors, participants and accompanying persons accept these rules as binding.

  2. Paddock and pit boxes

  • The space in front of a rented box belongs exclusively to the renter. Floor markings must be observed. Anyone who has not rented a box should use the general paddock.

  • Vehicles in the paddock must be parked one behind the other to save space; do not leave unnecessary gaps.

  • Tents, tarpaulins, umbrellas, etc. must be secured so that they are not damaged or blown away in wind or storms. The person responsible is liable for any damage.

  • Drilling in the paddock is prohibited. Damage may be subject to legal action.

  • Inflatable pools may only be set up with the permission of the race track management.

  • Hot barbecue residues must not be disposed of in rubbish bins. Fire hazard and compensation for damages possible.

  1. Safety, Noise and Behaviour

  • Test runs of vehicles with fuel are prohibited between 10 p.m. and 7 a.m.

  • Quiet hours from 10 p.m. to 7 a.m.: Music, noise or loud conversations are prohibited; noise levels must not disturb others.

  • Unnecessary noise is generally prohibited.

  • Wheelies, stoppies, burnouts and other motorcycle stunts are prohibited.

  • Fighting, aggressive or grossly inappropriate behaviour is prohibited. Friendly coexistence is expected.

  1. Environment, litter and fire

  • Rubbish must be disposed of in the designated bins. Hazardous waste, old tyres, etc. brought to the site may not be left behind.

  • Old tyres must be taken away or disposed of at the tyre service for a fee.

  • Dispose of waste oil in the designated containers at the race track.

  • Only dispose of cigarette butts in ashtrays. Smoking bans must be observed.

  • Fireworks are only permitted with the permission of the organiser and the race track management.

  1. Children, animals and entering the premises

  • Parents are responsible for their children. Children may only remain in the paddock under the supervision of authorised persons.

  • Animals must be kept on a leash; owners are liable for any damage caused.

  • Children and animals are not permitted to enter the race track or pit lane. Please cross roads with caution.

  1. Photography, drones and data protection

  • Photography on the track or in the infield is only permitted with the permission of the organiser and the race track.

  • Drones are strictly prohibited; exceptions only with permission.

  • Data protection: Name, start number and motorcycle will be published permanently on the homepage; photos, videos and race results may be used for advertising purposes. Please send any objections by email to Karl Fröschl Event GmbH.

  1. House rules

  • The organiser reserves the right to enforce house rules throughout the entire event. Instructions must be strictly followed.

  • Violations of house rules or instructions may result in immediate and irrevocable exclusion from the race track.
